Re: [IPp] 504 Protection in a private school
Legally, the school does not have to do anything just as others have told
you....however there may be some state laws to help in your state but,
frankly, my daughter was in public school for four years before we started
homeschooling (and she appears to want to return for her junior and senior
years) and was never late due to D.....if there were bg issues, I told the
nurse when I took her to school......we are all different I know but your
school offered more than I have seen in many private schools.............good
luck to you........

I've asked this forum questions before regarding a 504 plan for my 14 year
old
daughter who goes to a private Catholic School in Central New York. The
school was giving my daughter detention when she had over 3 late mornings.
That is their policy for all students who are late who don't have a
doctor's
excuse. If a child is home sick and they arrive at school late, even if the
parent calls and/or sends in a note, it is considered an "illegal"
absence.
So, when my daughter received her first detention I called the school. They
did take away her detention but they said they wanted a 504 plan. Now, her
current procedure when she's late is she receives the detention slip, has
to
go to the vice principals office every time she's late to verify her
lateness
was due to diabetes. THen if she said is was due to diabetes they take the
detention away. Well, on her late mornings,I've already called the school
and told them that at 7:30 a.m. that she is sick due to diabetes. So, I
complained stating she shouldn't have to go through this "ritual"
every time
she's late. I've already called them and told them she was sick. She
should
not be given a detention sheet in the first place and she shouldn't have to
see the vice principal every time. The Diocese got very upset that I dared
to
say she shouldn't have to do this and they said because they are a private
school they don't have to follow the same rules as a public school.
Anyway,
meanwhile, my duaghter's doctor sent in her accommodations to the Catholic
Diocese requesting a 504 review. Now, since the DIocese got so angry with my
earlier objections about detention I'm afraid they will not honor the
doctors
request. When I called the state to see what protection my daughter has they
pretty much told me since it's a private school she doesn't have any
protection. Her school does NOT get federal financial aid, which according
to the official from the state, that eliminates her protection with the 504
Rehabilitation Act and ADA Act. One Act states that the school must receive
federal financial aid and the other states religious institutions aren't
covered. I'm hoping he's wrong! Does anyone know the answer to this?
Just
because my daughter's in a private school does that mean there's not a
bill or
a law that will protect her from the Diocese not honoring her doctors
accommodations? How can the school decide, for instance, not allow Maria to
have a water bottle with her at all times? Or how can they NOT accommodate
her if she gets ill in the middle of an exam and not let her make it up? I
thought the schools were suppose to care about the children...not their egos!
Any suggestions????????? Thanks!!
