Be aware though that self-funded plans basically are not included in state
laws for coverage of diabetes supplies, nor are Medicare recipients covered.

As examples:

NYS:
WHO IS NOT COVERED BY THE NEW LAW?
* You are not covered if your plan is a "self-funded" plan governed by a
federal law called "ERISA."

* You are not covered if you are a Medicare* (see below) or Medicaid
recipient. Passage of this legislation does NOT change the coverage in these
programs.

Your benefits manager or human resource department should be able to tell
you about your plan.

NC:
WHO IS NOT COVERED BY THE NEW LAW?
* You are not covered if your plan is a specified accident, specified
disease, hospital indemnity, or long-term health insurance policy.

* You are not covered if you are a Medicare* (see below) or Medicaid
recipient. Passage of this legislation does NOT change the coverage in these

* You may not be covered if your plan is a "self-funded" plan governed by a
federal law called "ERISA."

Your benefits manager or human resource department should be able to tell

So, it seems that for "self-funded" plans, more regulations is needed.
