The FDA issues an approval. The did this a year or two ago for 
Naprosin, a very strong anti-inflamatory pain reliever in the 
xxprofen family. It is still available in larger doses by 
prescription, although you could take 2 of the over the counter ones 
for the same effect.

If EMLA is OTC, it would have to be the appropriate strength to be 
useful. Using twice as much of 2% would not give the same effect as 
4% so denial based on availability OTC would have to be the identical
